The Bureau of Ocean Energy Management is responsible for offshore renewable energy development in federal waters (3 nm out to 200 nm). BOEM is required to comply with the National Environmental Policy Act (NEPA), prior to approving a Construction and Operations Plan for any offshore wind project on the Outer Continental Shelf.
NEPA requires federal agencies to assess the environmental effects of proposed major federal actions prior to making decisions and requires agencies to seek input from stakeholders (i.e., the public) throughout the process.
The permitting process for Kitty Hawk Wind will require 27 approvals by federal, state, and local regulatory agencies, including but not limited those below:
